Jewish law has a history stretching from the early period to the modern State of Israel, encompassing the Talmud, Geonic and later codifications, the Spanish Golden Age, medieval and modern responsa, the Holocaust and modern reforms. Fifteen distinct periods are separately studied in this volume, each one by a leading specialist, and the emphasis throughout is on the development of the institutions and sources of the law.

High-spin states have been studied in Pr-135(59), populated through the Cd-116(Na-23,4n) reaction at 115 MeV, using the Gammasphere gamma-ray spectrometer. The negative-parity yrast band has been significantly extended to spin similar to 45 (h) over bar and excitation energy 21.5 MeV, showing evidence for several rotational alignments. The positive-parity yrast band of Ce-135(58), populated through the p4n channel of this reaction, was also populated to spin similar to 38 (h) over bar and excitation energy 18 MeV. A provocateur does not pose a threat of harm. Hence, a forceful response to provocation is generally considered wrongful. And yet, a provocateur is often denied recourse to a self-defence justification if she defends herself against such a violent response. In recent work, Kimberly Ferzan argues that a provocateur forfeits defensive rights but this forfeiture cannot be explained in the same way as an aggressor’s rights forfeiture. Ordinarily, one forfeits the right not to be harmed and to self-defend against harm (...) by threatening to violate another person’s rights. But provocateurs forfeit their defensive rights because they bring about the situation in which defence becomes necessary. As I argue here, positing these two types of forfeiture justifications is neither desirable nor necessary. I suggest a unified rights forfeiture account that grounds rights forfeiture in moral responsibility for an unjust threat. My account offers clearer distinctions than alternative unified accounts, which I briefly discuss. Furthermore, the account can provide better explanations of intuitively plausible judgements. A provocateur will have less extensive defensive rights than an innocent victim, but will not lose all her defensive rights simply because ‘she started it.’. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:Journal of the History of Ideas 61.2 (2000) 285-304 [Access article in PDF] Vacher de Lapouge and the Rise of Nazi Science Jennifer Michael Hecht * In the literature on the history of the Shoah the existence of a tradition of explicit anti-morality has been generally ignored. 1 This article argues that the materialist anthropology of the late nineteenth and early twentieth centuries waged a direct attack on (...) morality, which was described as inherently linked to religion. Strict materialism also denied any human access to the eternal except through biological lineage, linking the past, present, and future. This concern with procreation, which culminated in a desire to change the racial content of the world, led anthropology to aim its attack on morality on restrictive sexual mores and the injunction not to kill. Still, anti-morality was not conjured up in order to further eugenics; it was an independent idea and an explicit response to the loss of God. The anthropologist who best illustrates this scientific anti-morality is Georges Vacher de Lapouge, the French inventor of "anthroposociology." The present article explicates Lapouge's anti-morality and establishes a connection between his racial theories and those of a coterie of German colleagues. Most notable among these German colleagues was Hans Günther, whose vision had a role in shaping Nazi racial policy, in particular the Nazi interest in head measurements. Scholars investigating the origins of German racism have discovered French influence but have focused on Gobineau and his almost anti-scientific literary racism. This article argues that Lapouge and his scientific racism were also important.The relative significance of ideology in the "Final Solution" is the subject of some debate. This article seeks not to enter that debate but rather to reevaluate the nature of the ideology. It seems clear that whatever may have been the relative importance of ideas to, for instance, mundane careerism and conformity, the [End Page 285] ideas did play a role. 2 Within that context it will be demonstrated that Lapouge's anthroposociology helped to legitimate racialist utopianism. The scientific status of anthroposociology was deliberately engaged as propaganda for the regime, even after the specifics of its injunctions were no longer of much interest to the programmers of genocide.Whatever made people enact and accept genocide as daily routine, the idea of it came from somewhere, and somehow "the moral sensitivities" of the people were dulled. 3 Increasingly, historians stress that along with older forms of anti-Semitism, new scientific doctrines had a direct effect on events. There are a number of studies on the role of science in National Socialist doctrine, but they tend to be more about the role of doctors and the medical model of society than they are about anthropology. 4 Those that do deal with anthropology tend to mention Lapouge as an interesting forerunner but consistently fail to recognize his direct influence on Nazi doctrine. 5Lapouge's contribution to racism was a quantitative, well-written race theory that was replete with the language and tools of science. It was particularly appealing because it described a collection of human groups which sounded too scientific and clinical to be political. The value-laden descriptions of these clinical types (based on head shape) were easily transferred to known "racial" or social groups--with the simple claim that this or that group tended to have this or that head shape. Lapougian race theory was convincing because it was alien and yet confirmed familiar suspicions. It was thus highly instrumental in vitalizing dormant or mild prejudice. These ideas (and the endless columns of measurements and descriptions of head shapes) have grown so foreign to present day beliefs that they have become somewhat invisible to our eyes. Because of this, historians have not fully appreciated one of the important factors contributing to the "respectability" and credibility of a genocidal doctrine.In studying people who were guilty of unparalleled cruelty, historians expected to find moral agony and found instead a bureaucratic, mechanistic, banality. We present a new road map for research on “How the Brain Got Language” that adopts an EvoDevoSocio perspective and highlights comparative neuroprimatology – the comparative study of brain, behavior and communication in extant monkeys and great apes – as providing a key grounding for hypotheses on the last common ancestor of humans and monkeys and chimpanzees and the processes which guided the evolution LCA-m → LCA-c → protohumans → H. sapiens. Medium- and high-spin states of Pr-134 were populated using the Cd-116(Na-23, 5n) reaction and studied with the GAMMASPHERE spectrometer. Several new bands have been found in this nucleus, one of them being linked to the previously observed chiral-candidate twin-band structure. The ground state of Pr-134 could be determined through establishing a level structure that connects the two previously known long-lived isomeric states. Unambiguous spin-parity assignments for the excited states could be performed based on the known 2(-) spin-parity of the ground (...) state combined with the present experimental data. Intrinsic single-particle configurations have been assigned to the newly observed bands on the basis of the measured B(M1)/B(E2) ratios, alignments, band-crossing frequencies, bandhead spins, the observed single-particle configurations in the neighboring nuclei, and taking into account the predictions of total Routhian surface and tilted-axis cranking calculations. There has been a recent surge of interest in ancient accounts of free will. It is surprising, then, that there have been virtually no attempts to discuss whether Plato had such an account. Those who have made an attempt quickly deny that such an account is present in the dialogues. I shall argue that if we draw a distinction between two notions of free will, it is plausible that some account of free will is, in fact, present in the dialogues, (...) the Republic in particular. This is the first in depth search into the question and I demonstrate that the defender of a Platonic free will thesis has more resources than she first appears to. It also has the benefit of giving us an obvious source material for Augustine's discussion. (shrink)

A magisterial exploration of poetry’s place in the fine arts by one of the twentieth century's leading poets In this book, eminent poet Anthony Hecht explores the art of poetry and its relationship to the other fine arts. While the problems he treats entail both philosophic and theoretical discussion, he never allows abstract speculation to overshadow his delight in the written texts that he introduces, or in the specific examples of painting and music to which he refers. After discussing (...) literature’s links with painting and music, Hecht investigates the theme of paradise and wilderness, especially in Shakespeare’s The Tempest. He then turns to the question of public and private art, exploring the ways in which all the arts participate in balances between private and public modes of discourse, and between an exclusive or elitist role and the openly political. Beginning with a discussion of architecture as an illustration of a more general theme of discord and balance, the penultimate lecture probes the inner contradictions of works of art and our reactions to them, while the final piece concerns art and morality. The Formal Darwinism Project is an attempt to use mathematical theory to prove the claim that fitness maximization is the outcome of evolution in nature. Grafen’s (2014, p. 12) conclusion from this project is that “….there is a very general expectation of something close to fitness maximisation, which will convert into fitness-maximisation unless there are particular kinds of circumstances—and further, that fitness is the same quantity for all genetic architectures.” Grafen’s claim appears to mean to him that natural populations are (...) expected to contain individuals whose traits are optimal, i.e., any given trait outperforms all reasonable alternatives. I describe why Grafen’s attempt can never provide a meaningful expectation as to the ubiquity of optimal traits in nature. This is so because it is based upon a misconception of the relationship between theory and empirical analysis. Even if one could use theory in the way Grafen proposes, I describe how his theory is causally incomplete. Finally, I describe how Grafen’s conceptual framework is ambiguous. The Formal Darwinism Project has been inspired by “On The Origin of Species” by Darwin. The great lesson of this book was Darwin’s demonstration of the necessary dialog between theory and data, with each influencing and being influenced by the other. Grafen’s Formal Darwinism Project, an attempt to create understanding of nature by removing data from this dialog, reflects a failure to understand Darwin’s great lesson. (shrink)

In today’s multi-cultural world and global economy, attention is often focused on the diversity of cultural values and practices and the need for management approaches to take these differing cultural environments into account. While there is much to be valued in this approach, the focus is often on how to navigate through distinct cultural practices in order to achieve a singular business aim, which falls within the current neoliberal paradigm of global trade. In addition, by focusing on differences in cultural (...) practices, rather than on similarities in underlying values, this approach fails to utilize an important way to achieve a greater degree of global integration in management. Despite striking cultural differences, it is possible to identify some enduring values that underlie what often appear to be quite discrete value paradigms, especially by looking at value paradigms that have endured for centuries, even millennia. This paper proposes to explore the values embedded in two such value paradigms or religious traditions, zen buddhism and Judaism, describing crucial core values in each and comparing and contrasting their ethical frameworks, in order to be able to evaluate their utility in today’s world and especially their significance for creating a more holistic, inclusive, and responsible management framework. The paper will begin by explicating the set of foundational values in each religious tradition. For example, zen buddhism, especially as expressed by Vietnamese monk Thich Nhan Hanh, utilizes the concepts of engaged mindfulness and inter-being to demonstrate the ways in which all global issues are linked together, and the collective responsibility that all humans bear for the state of our planet and the beings who live on it. This approach is inherently holistic and inclusive, and requires a management approach that takes into account the moral responsibility that we all carry. Likewise, the Jewish tradition, while using quite different terminology, also lays out a holistic and inclusive moral vision. Key concepts include the values of Tikkum Olam, to repair the world, and Tsedakah, which literally means justice or righteousness, but is commonly used to indicate charitable giving. The first value, to repair the world, emphasizes the collective moral responsibility to heal whatever damage has been done to the world in order to make the it a better place for all. It does not matter who has done the damage; what matters is each person’s obligation to improve the status quo, under the assumption that all our fates are linked together. The second value, justice and charity, is also considered to be a moral obligation, not simply a voluntary act of charity. The emphasis here is on anonymous giving, done in order to help others and without any expectation of receiving some benefit, such as positive publicity. As a moral obligation, it is not something that one should benefit from. Thus, the concept of tsekakah also emphasizes the inter-connectedness of all humanity. In addition, in the Torah, there are a series of rules about how to deal with others in business as well as the obligation, during harvest-time, to leave some grain in the fields for the less fortunate. In all, we see a focus on being mindful of others, on seeing our fates as interconnected, as in zen buddhism. The last section of the paper will explore some of the ways in which these moral imperatives can be utilized to undergird and buttress a more holistic, inclusive and responsible management approach. Some management models already include moral imperatives, such as corporal social responsibility, and this section will explore in greater detail how the above concepts have been more fully integrated into current management models. Narrative form is crucial to the understanding of science in popular culture. This is particularly true with subjects such as radiation, in which the technical details at hand are often remote from everyday experience—as well as contested or uncertain among experts. This article examines the narrative choices made by three popular texts that publicized radiation risks to the public during the Cold War: John Hersey's Hiroshima, David Bradley's No Place to Hide, and Ralph Lapp's The Voyage of the Lucky Dragon. (...) It contends that each author borrowed from well-established literary genres and that this borrowing was crucial to coherence and effective messaging of the argument. Empirical research on the perception of physical events is rarely designed to test a particular theory. The research often fails to be embedded in a larger theoretical context or it is carried out with the implicit goal to support a particular theoretical approach. I argue that this is not very productive. While three theories are relevant for our understanding of events, their limits have rarely been addressed. I expose these limits. The three theories or approaches are direct or ecological perception, (...) inference theory, and the concept of internalization. I demonstrate that all three fail empirically and/or theoretically with respect to explaining the perception of events. They fail because they adhere to simplistic stationary views or because they remain too vague. An adequate theory of event perception has to include three factors at the level of the explanans, namely the stimulus, the purpose of the action to which the percept belongs, and the appraisal of this action's success. Examples from the domains of arrival-time judgment and perception of events involving classical mechanics are used to support the claims. I suggest that a new pragmatic theory of event perception ought to modify and to incorporate the three concepts of affordances, thought-like processes, and evolutionary principles. (shrink)

Argumentation is considered crucial in numerous disciplines in schools and universities because it constitutes an important proficiency in peoples' daily and professional lives. However, it is unclear whether argumentation is understood and practiced in comparable ways across disciplines. This study consequently examined empirically how students perceive argumentation in science and language lessons. Specifically, we investigated students' beliefs about the relevance of discourse and the role of facts. Data from 3,258 high school students from 85 German secondary schools were analyzed with (...) multigroup multilevel structural equation modeling in order to disentangle whether or not differences in argumentation across disciplines exist and the extent to which variation in students' beliefs can be explained by gender and school track. Results showed that students perceived the role of facts as highly relevant for science lessons, whereas discursive characteristics were considered significantly less important. In turn, discourse played a central role in language lessons, which was believed to require less knowledge of facts. These differences were independent of students' gender. In contrast, school track predicted the differences in beliefs significantly. Our findings lend evidence on the existence of disciplinary school cultures in argumentation that may be the result of differences in teachers' school-track-specific classroom practice and education. Implications in terms of a teacher's role in establishing norms for scientific argumentation as well as the impact of students' beliefs on their learning outcomes are discussed. (shrink)

Mindfulness and compassion meditation are thought to cultivate prosocial behavior. However, the lack of diverse representation within both scientific and participant populations in contemplative neuroscience may limit generalizability and translation of prior findings. To address these issues, we propose a research framework calledIntersectional Neurosciencewhich adapts research procedures to be more inclusive of under-represented groups. Intersectional Neuroscience builds inclusive processes into research design using two main approaches: 1) community engagement with diverse participants, and 2) individualized multivariate neuroscience methods to accommodate neural (...) diversity. We tested the feasibility of this framework in partnership with a diverse U.S. meditation center (East Bay Meditation Center, Oakland, CA). Using focus group and community feedback, we adapted functional magnetic resonance imaging (fMRI) screening and recruitment procedures to be inclusive of participants from various under-represented groups, including racial and ethnic minorities, gender and sexual minorities, people with disabilities, neuropsychiatric disorders, and/or lower income. Using person-centered screening and study materials, we recruited and scanned 15 diverse meditators (80% racial/ethnic minorities, 53% gender and sexual minorities). The participants completed the EMBODY task – which applies individualized machine learning algorithms to fMRI data – to identify mental states during breath-focused meditation, a basic skill that stabilizes attention to support interoception and compassion. All 15 meditators’ unique brain patterns were recognized by machine learning algorithms significantly above chance levels. These individualized brain patterns were used to decode the internal focus of attention throughout a 10-min breath-focused meditation period, specific to each meditator. These data were used to compile individual-level attention profiles during meditation, such as the percentage time attending to the breath, mind wandering, or engaging in self-referential processing. This study provides feasibility of employing an intersectional neuroscience approach to include diverse participants and develop individualized neural metrics of meditation practice. Through inclusion of more under-represented groups while developing reciprocal partnerships, intersectional neuroscience turns the research process into an embodied form of social action. (shrink)

According to the standard (recent) history of connectionism (see for example the accounts offered by Hecht-Nielsen (1990: pp. 14-19) and Dreyfus and Dreyfus (1988), or Papert's (1988: pp. 3-4) somewhat whimsical description), in the early days of Classical Computational Theory of Mind (CCTM) based AI research, there was also another allegedly distinct approach, one based upon network models. The work on network models seems to fall broadly within the scope of the term 'connectionist' (see Aizawa 1992), although the term (...) had yet to be coined at the time. These two approaches were "two daughter sciences" according to Papert (1988: p. 3). The fundamental difference between these two 'daughters', lay (according to Dreyfus and Dreyfus (1988: p. 16)) in what they took to be the paradigm of intelligence. Kubovy and Epstein's main quarrel is with the concept of “internalization.” I argue that they underestimate the aptness of this metaphor. In particular, an emulator which predicts unfolding events can be described as an internalization of external structures. Further, an emulator may use motoric as well as perceptual resources, which lends support to Hecht's proposal. [Hecht; Kubovy & Epstein].

Shepard's notion of “internalisation” is better interpreted as a simile than a metaphor. A fractal encoding model of visual perception is sketched, in which image elements are transformed in such a way as to maximise symmetry with the current input. This view, in which the transforming system embodies what has been internalised, resolves some problems raised by the metaphoric interpretation. [Hecht; Shepard].

Shepard's internalization concept is defended against Hecht's criticisms. By ignoring both Shepard's evolutionary perspective and the fact that internalization does not preclude modularization, Hecht advances inconclusive evidence. Developmental research supports Shepard's conclusion that kinematic geometry may be more deeply internalized than physical dynamics. This research also suggests that the internalization concept should be broadened to include representations acquired during ontogeny. [Hecht; Shepard].

Shepard's (1994) choice of kinematic geometry to support his theory is questioned by Todorovic, Schwartz, and Hecht. His theoretical framework, however, can be applied to another domain that may be less susceptible to some of their concerns. The domain is the representation of spatial layout. Shepard's analysis of how shape, motion, and color are perceptually represented can be generalized. Apparent motion and shape may be associated with a group of spatial transformations, accounting for rigid and plastic motion, and perceived object color may be associated with a group of illuminant transformations, accounting for the discriminability of surface-reflectance changes and illuminant changes beyond daylight. The phenomenological and mathematical parallels between these perceptual domains may indicate common organizational rules, rather than specific ecological adaptations. The epistemological challenges of the Anthropocene trouble distinctions of solid and fluid. In this contribution, the author proposes, after Gabrielle Hecht, that the nuclearity of the Anthropocene contributes significantly to destabilising these categories. Nuclear materials and ideas of nuclearity force (re)consideration of deep timescales and imperceptible processes, problematising fixed material ontologies. The article engages with nuclear matters and queries the logic of solids and fluids by developing the notion of elemental memory. An attention to elemental memory – an element’s (...) capacity to auto-affect over time – reveals the inadequacy of terms like solid and fluid, and highlights the expressiveness of solid fluid substances. Empirically, the author demonstrates, first, how elemental memory informs the solid-fluid processuality of radioactive glasses, especially trinitite. Second, engaging with the work of artists Mari Keto and Erich Berger, she addresses the slow auto-transformations of radioactive minerals. (shrink)

This essay is a historical–geographical account of how scientists and public health officials conceptualized and assessed northern radioactive exposures in the late 1950s and 1960s. The detection of radionuclides in caribou bodies in northern Canada both demonstrated the global reach of nuclear fallout and revealed the unevenness of toxic relations and radioactive exposures. Following the documentation of the lichen–caribou–human pathway of exposure, Canadian public health officials became increasingly concerned about the possibility of heightened radioactive exposures among Indigenous northerners. Between 1963 (...) and 1969, scientists and officials with Canada’s Radiation Protection Division coordinated an interdepartmental monitoring program through which they sought to determine whether the consumption of contaminated caribou meat had caused radioactive exposure levels in northern communities to exceed the officially recognized “safe limits.” In 1969, the northern monitoring program was suspended after officials determined that radionuclide body burdens had not exceeded the threshold for radioactive exposures. While the RPD emphasized its development of a technoscientific approach to measuring radioactive body burdens, the legitimacy of the monitoring program was linked directly to interdepartmental relations within Canada’s colonial northern administration. I situate the northern monitoring program within broader shifts in public health approaches to radiation protection and use Gabrielle Hecht’s concept of nuclearity to demonstrate how RPD officials employed the logic of the threshold in their assessment of radioactive exposures. Een essentieel punt in zijn filosofie is gedragsbeïnvloeding. Beccaria hecht veel waarde aan het codificeren en kenbaar maken van (duidelijk opgestelde) wetten. Hierdoor weten burgers welke gedragingen strafbaar zijn gesteld en worden – zo is de veronderstelling van hem – door die strafrechtelijke kennis beïnvloed strafbaar gedrag achterwege te laten. (...) This paper treats Deleuze's first synthesis of time and the corresponding concept of larval subjectivity by routing it through a biophilosophy of organism. I develop, out of my reading of Deleuze, a temporal concept of organismic subjectivity.

What is the significance of that loose collective enterprise, sprung up in the aftermath of the sixties, known as L=A=N=G=U=A=G=E Writing? To answer this question I will be taking, initially, a somewhat oblique route. And I shall assume an agreement on several important social and political matters: first, that the United States, following the Second World War, assumed definitive leadership of a capitalist empire; second, that its position of leadership generated a network of internal social contradictions which persist to this (...) day ; third, that this postwar period has been characterized, at the international level, by an extended cold war shadowed by the threat of a global catastrophe, whether deliberate or accidental. Whatever one’s political allegiances, these truths, surely, we hold as self-evident.Postwar American poetry is deployed within that general arena, and to the degree that it is “political” at all, it reflects and responds to that set of overriding circumstances.1 In my view the period ought to be seen as falling into two phases. The first phase stretches from about 1946 to 1973 . This period is dominated by a conflict between various lines of traditional poetry, on one hand, and the countering urgencies of the “New American Poetry” on the other. In the diversity of this last group Donald Allen argued for a unifying “characteristic”: “a total rejection of all those qualities typical of academic verse.”2Of course, this representation of the conflict between “tradition” and “innovation” obscures nearly as much as it clarifies. The New American poets were, in general, must moe inclined to experimentalism than were writers like Richard Wilbur, Anthony Hecht, Louis Simpson, or Donald Justice. But Allen’s declaration can easily conceal the academic and literary characteristics of the innovators. Robert Duncan and Charles Olson, for example, key figures in the New American Poetry, can hardly not be called “literary” or even “academic” poets. If they opened certain new areas in the field of poetic style, no less could and has been said of Lowell, even in his early work.
